The short answer

Yes, and which office issues the permit depends on your address.

We build decks, fences, screened porches and remodels in Haralson County, Bremen, Tallapoosa and Buchanan. A deck or porch needs a permit nearly everywhere, but the county and each city write their own rules.

Send Ambrose a quote request with the address and the plan. We will tell you whether the county or a city has the permit, and what that office asks for, before you file.

The rules

Four codes, four sets of rules.

Haralson County and its three cities each write their own rules, and every rule below links to its section on Municode. Offices read their own codes, so confirm your lot before you pay anyone.

Unincorporated Haralson County

  • No county permit is issued unless the work complies with the county zoning chapter, and the permit must be in hand before any work is done.

Haralson County Code, Sec. 10-177Haralson County, Permits and Licenses

  • For an exterior appurtenance attached to a building, the permit needs a sketch showing the approximate square footage and the distance from the house and the property line, plus a copy of the approved septic permit or the sewer tap-on approval. The code does not name decks, so ask the office whether yours counts.

    Haralson County Code, Sec. 10-183

  • A permit is valid for one year, with two free one-year extensions if you ask in writing before it expires and send proof of a current septic permit or sewer connection.

    Haralson County Code, Sec. 10-184

  • Accessory buildings in residential areas go only in the rear or side yard, at least ten feet from the side and rear property lines. Garages, barns and hay sheds skip building code inspection, with an electrical inspection only if power enters them.

Haralson County Code, Sec. 50-108(d)Haralson County Code, Sec. 10-216

Bremen

  • A fence needs a city permit and an application fee. In residential zones a solid fence stops at six feet in the rear and side yards. A front-yard fence must be open style, such as picket or ornamental, and no taller than 3.5 feet, with no chain link.

    Bremen Code, Sec. 110-74

  • An accessory structure goes in a side or rear yard, at least five feet from any property line if it is 200 square feet or less. Larger ones follow the standard setbacks. None may be built before the main building.

    Bremen Code, Sec. 110-75

  • Bremen's code counts decks as impervious surface. In the Beach Creek watershed, no impervious surface may go within 150 feet of a perennial stream within seven miles upstream of the city intake, and septic tanks and drain fields are barred there too. Beyond seven miles the setback is 75 feet.

Bremen Code, Sec. 106-59Bremen Code, Sec. 106-61(b)

Tallapoosa

  • The city names decks, porches and fences as permit projects. Below a cost ceiling the code sets, projects with load-bearing parts, or with a bearing on a neighbor's property line, are processed and inspected at no cost to the owner.

    Tallapoosa Code, Sec. 18-5(a)

  • New fencing must be uniform in construction and design. Mismatched leftover boards, paneling, metal or vinyl scraps are not permitted.

    Tallapoosa Code, Sec. 18-24(u)

  • Concrete footings must be at least 12 inches thick and wide with two runs of #4 rebar, and the supplier must send a letter confirming the concrete strength.

    Tallapoosa Code, Sec. 18-24(c)

How it goes

From the first call to the finished job.

  1. Send the address

The address tells us whether the county, Bremen, Tallapoosa or Buchanan issues the permit.

  2. Plan to the rules

Setbacks, fence height and footing specs differ by code, so the plan follows the one that applies.

  3. Permit

A sketch with square footage and distances to the lines, plus septic papers in the county. The permit is in hand before work starts.

  4. Build and inspect

We build to the approved plan, then the inspection the permit calls for.

Questions

Straight answers.

Do I need a permit for a deck in Haralson County?

Expect to. For an attached exterior appurtenance the county wants a sketch and your septic permit or sewer tap-on approval. The code does not use the word deck, so confirm with the Zoning and Permits Office.

What fence can I put in a Bremen front yard?

An open-style fence such as picket or ornamental, no taller than 3.5 feet, with a city permit. Chain link is not allowed there. Solid fences up to six feet go in the rear and side yards.

Does Tallapoosa inspect a small deck for free?

Often. Deck, porch and fence projects under a cost ceiling are processed and inspected at no cost to the owner. Check the current figure with the city.

Which office do I call for a Buchanan address?

Inside city limits, the city issues the permit. Outside them it is the county, whose Zoning and Permits Office is also in Buchanan, so check which side of the line your lot is on.
